Electronic Access to Sealed and Restricted Documents and Service of Same

On March 31, 2026, Chief Judge Matthew H. Solomson issued Amended General Order No. 2026-01 restricting electronic access to sealed and restricted documents. Sealed and restricted documents will continue to be filed in CM/ECF under existing procedures. Because sealed and restricted documents filed in CM/ECF will no longer be accessible or viewable electronically, service cannot be accomplished through CM/ECF. The court and the parties must serve all applicable sealed and restricted documents by other appropriate means as provided by RCFC 5(b)(2), and the parties must adhere to the certificate of service requirement set forth in RCFC 5(d)(1)(B).

Requests for copies of recently filed sealed and restricted documents must be directed to the filing party or, for court-issued documents (e.g., opinions and orders), the Clerk’s Office.

As provided in paragraph 2 of the General Order, filing parties must serve their sealed and restricted filings on all other parties outside of CM/ECF, while the court will serve court-issued documents on all parties outside of CM/ECF.

A suggested approach to service is to create a PDF of, or otherwise download and save, the e-mailed Notice of Electronic Filing (NEF), attach the NEF to the filing, and then serve that combined document on the other parties via hardcopy or e-mail. That will constitute a "file-stamped" copy.

While the Clerk’s Office serves court-issued documents with the CM/ECF header, the Clerk’s Office does not have the resources to provide all parties with a CM/ECF-stamped copy of their own filings. When necessary, the Clerk’s Office may provide copies of filed documents, but applicable copy fees will apply to all parties, including the Department of Justice.
